MAY 2 1936 <br />i' <br />BOOK 64 iv)E 564 <br />WORK & PURPOSE: <br />The applicant proposes to construct a 2,424 square foot dock. <br />The dock will be utilized as a multiple boat docking facility <br />and will accommodate twenty (20) boat slips. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />- The Hutchinson Island Planning & Management Plan <br />- The Indian River County Code of Laws and Ordinances <br />- Chapter 16Q-20 F.A.C. <br />The application states that the proposed dock will be utilized <br />as a residential multiple slip docking facility. <br />The Indian River County Code of Laws and Ordinances specifies <br />that residential dock structures are accessory uses to the <br />principal residential use. The applicant proposes to construct <br />a multiple -family townhouse development on the upland property. <br />In order to construct the proposed dock facility, the applicant <br />must obtain an approved site plan in conjunction with the <br />principal use. <br />Staff has not yet had the opportunity to conduct a field survey <br />of the water area, however, a detailed environmental analysis <br />will be conducted upon formal submittal of a site plan to the <br />County. <br />The proposed dock facility will be located within the Malabar - <br />Vero Beach State Aquatic Preserve and, as such, is subject to <br />Chapter 16Q-20 Florida Administrative Code. The Florida <br />Department of Natural Resources will issue a lease to the <br />submerged lands once the requirements to Chapter 16Q-20 have <br />been met by the applicant. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners <br />authorize staff to transmit a letter to the D.E.R. recommending <br />that: <br />1) The D.E.R. and other environmental agencies coordinate <br />with the County on environmental field investigations; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential <br />cumulative impacts of marina projects upon the Florida <br />manatee. <br />Staff further recommends that the applicant submit the <br />application along with a complete site plan application to the <br />Planning & Development Division for review and approval by the <br />Planning & Zoning Commission. <br />20 <br />
