Transportation System <br />Access to the site is through an easement along the South Relief <br />Canal connecting the subject property with Old Dixie Highway <br />(classified as a secondary collector on the Thoroughfare Plan). <br />The proposed rezoning will not decrease the existing level of <br />service "C" for this section of Old Dixie Highway. <br />Environment <br />The subject property is not designated as environmentally <br />sensitive. However, approximately one acre located along the <br />lateral J canal is designated as being located within flood zone <br />A which is an area most susceptible to a 100 year flood. The <br />remainder of the property is not designated as flood -prone. <br />Utilities <br />Neither County sewer nor water is available to the subject <br />property at the present time. <br />RECOMMENDATION <br />Based on the above analysis including both the Planning and <br />Zoning Commission's recommendation and the fact that the <br />residential zoning conversion ordinance changed the radio tower <br />from a conforming use to a nonconforming use and that this <br />proposed rezoning would bring the tower back into conformance <br />with the zoning ordinance, staff recommends approval. <br />The Chairman asked if anyone present wished to be heard. <br />There were none. <br />Acting Administrator Thomas noted that this property is <br />adjacent to the old dump, and he has been advised that the intent <br />still is to use this for recreation purposes in the future. He <br />believed we have been in the process of rezoning the balance of <br />our parks to Agricultural, and he would like the Board to <br />consider doing the same with the balance of this park property. <br />Chairman Scurlock inquired if Mr. Thomas wished the Board to <br />proceed with the subject rezoning today and then initiate a <br />request to rezone the balance, and he agreed. <br />The Chairman then informed the Board that in the license <br />agreement with WGYL, there is a 300' height limitation, and the <br />whole purpose of building the new tower is to go higher. He <br />believed the 300' figure was used simply because that was the <br />height of the tower at that time. <br />Chris Hubbard, manager of WGYL,. confirmed that was the <br />height of the tower at that time, and it may present a problem <br />because the lease mentions a 300' tower and associated <br />15 BOOK 64 FADE 6.0 <br />
