JUN <br />111986 <br />BOOK <br />64 F,� JF. <br />676 <br />Commissioner Wodtke asked how far that <br />ingress and <br />egress <br />is <br />from the canal right-of-way, and Judy Turner of Turner Builders <br />advised that she has a survey showing that right of way to be 60 <br />feet. She pointed out that the County paid a lot of money for <br />the engineering study done by Barton-Ashmann, which classified <br />that intersection as Traffic Level A, the least trafficked <br />category. The child care facility has been under study for the <br />last two years and will accommodate 79 children. It is assumed <br />that the children will come from areas to the south; the facility <br />is designed to pick up children from Indian River Heights, Oslo, <br />Laurelwood and other children of parents driving north to work. <br />L! <br />They have designed a residential structure to blend with the <br />residential area, and of the 150 people in the surrounding area <br />who have signed a petition objecting to this location for the <br />child care center, only the Johnstons to the east have asked to <br />see the actual site plan, and they agreed that it is everything <br />that we said it would be. She felt that the Hansons to the south <br />need to be protected as they have a common boundary, and stated <br />that the owners of the proposed facility are flexible as to what <br />kind of fence should be constructed. The structure is one-third <br />again as large as it needs to be for 79 children and the children <br />will only be on the playground for 2-4 hours a day. Mrs. Turner <br />did not feel that just driving by the intersection was a fair way <br />to tell how busy it would become. She reported that the State <br />Legislature had recently passed House Bill 782 entitled, "An Act <br />Relating to Child Care" exempting such homes from certain local <br />zoning regulations. In Section 3 of the bill, it specifically <br />states: "The operation of a residence as a family day care home <br />as defined by law, registered or licensed with Health & <br />Rehabilitative Services, shall constitute a valid residential use <br />for purposes of local zoning regulations and no such regulations <br />shall require the owner or operator of such family day care home <br />to obtain any special exemption or use, permit or waiver or to <br />14 <br />
