2. Allowing as a community dock <br />If the Board is to consider allowing the dock to remain as a community dock for Riverside Estates <br />residents, a number of items will need to be addressed. Those items include: <br />• Establishing a lease with a community entity. Currently, there is no Riverside Estates <br />homeowner's association. Consequently, a community organization would need to be created <br />before the County could consider leasing the property for community dock purposes. <br />• Managing access and use: any established association would need to manage subdivision -wide <br />demands for a small-scale facility. Under this scenario, only subdivision residents would benefit <br />from the river access and structures. <br />• Liability insurance: any County lease for exclusive use of county property for a community dock <br />would require a certificate of insurance from the leasing entity, naming Indian River County as <br />an insured under the certificate. <br />• After -the -fact permitting and responsibility for permitting: the currently unpermitted structures <br />would need to be modified and brought into compliance with the Florida Building Code. Any <br />established association would be responsible for managing, designing, permitting, and <br />completing required structural modifications. <br />3. Allowing as a dock'open to thee�public <br />If the County chooses to allow the dock to remain for non-exclusive use ,by the general public, the <br />following items would need to be addressed: <br />• Managing access and use: under this scenario, the County would need to manage public demand <br />for use of a small-scale facility. <br />• Modifications to the dock structures: the County would need to modify the structures to meet <br />Florida Building Code requirements, including accessibility modifications to meet Americans <br />with Disabilities Act (ADA) requirements. ADA compliance would likely involve removal and <br />re -building of most of the improvements. <br />• After -the -fact permitting and responsibility for permitting: the County would need to obtain <br />exemption verification from the FDEP; assume responsibility for managing, designing, <br />permitting, and completing required modifications, including accessibility requirements. <br />• Accommodation of parking. There is no opportunity for public parking or for vehicle drop-off of <br />canoes/kayaks at the dock, which is located at the "T" intersection of Morningside Drive and <br />Jungle Trail. Any general public use of the dock for canoe/kayak launch would entail portaging <br />from any vehicle parking accommodated on the north portion of the Jones's Pier property +500 <br />feet to the north. Portage activity for that distance along Jungle Trail could present a traffic <br />safety hazard. <br />After considering the three alternatives summarized herein, staff's position is that the dock and <br />associated unpermitted structures should be removed.
