eliminate the liability of unpermitted structures that do not meet building code standards on county - <br />owned land. <br />Allowing the existing dock structures to remain for exclusive use by residents of Riverside Estates is not <br />a recommended option for a number of reasons: the structures do not meet building code requirements <br />and would need to be substantially rebuilt; there is no existing community association to lease the <br />property to; and the location is not conducive for subdivision -wide use. The shoreline of the subject <br />county -owned riverfront strip has historically consisted of a limited opening in the mangrove fringe for <br />many years, and once the dock structures are removed, nearby residents will still have the opportunity to <br />informally launch kayaks or canoes from the shoreline, albeit without formal structures or improvements. <br />Removal of the dock structures is recommended instead of allowing the structures to remain -for general <br />public use, because the location of the dock is not conducive for parking, vehicle drop-off of canoes or <br />kayaks, or for portaging from the Jones's Pier property. Moreover, the dock structures would need to be <br />substantially reconstructed to meet building code requirements, including ADA accessibility <br />requirements, and would need to be managed by the County on an on-going basis at a location that is <br />nearby to an already existing public riverfront facility (i.e., the Jones's Pier property). <br />Funding for Removal Option <br />The County's Florida Boating Improvement Fund is an appropriate funding source for costs associated <br />with removal of the dock and associated structures. The cost is estimated to be between $3,000 and <br />$4,000 for the County to hire a marine contractor to conduct the work. No cost estimate or funding <br />source information is available at this time for option 3 (public dock). <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners authorize staff to solicit bids and select a <br />marine contractor to remove the unpermitted dock and associated structures on and adjacent to the <br />county -owned shoreline property west of Morningside Drive, using Florida Boating Improvement Funds <br />to pay for the removal, estimated to cost between $3,000 and $4,000. <br />ATTACHMENTS <br />1.
