ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zone Management Element of <br />the Indian River Comprehensive Plan; <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region; and <br />- The Hutchinson Island Resource Planning & Management <br />Plan. <br />- The Code of Laws & Ordinances of Indian River County <br />- Chapter 16Q-20 F.A.C. <br />The Indian River County Code of Laws & Ordinances specifies <br />that residential dock structures are accessory uses to the <br />principal residential use. The applicant is presently develop- <br />ing a single-family subdivision and until final plat approval <br />is obtained, the lots in Orchid Isle Estates cannot be sold or <br />have homes built upon them. In order to construct the proposed <br />dock facility, the applicant must have a principal structure on <br />Lot #58. <br />The proposed dock facility will be located within the Malabar - <br />Vero Beach State Aquatic Preserve and, as such, is subject to <br />Chapter 16Q-20 Florida Administrative Code. A staff review of <br />Chapter 16Q-20 finds that the proposed dock dimensions comply <br />with the size standards set forth in the rule. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners author- <br />ize staff to transmit a letter to the D.E.R. with the following'' <br />comments: <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumula- <br />tive impacts of the dockage project upon the Florida <br />Manatee; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of the project on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River. <br />3) No dock construction shall be permitted by Indian River <br />County until the requirements of all local ordinances <br />related to dock facilities and mangrove protection have <br />been addressed. <br />ON MOTION by Commissioner Bird, SECONDED by Commis- <br />sioner Bowman, the Board unanimously authorized <br />staff to transmit letter to the DER as recommended <br />in the above memo dated June 9, 1986. <br />I.
