JUL 21986 <br />.A <br />BOOK 64 FADE 85® 7 <br />The above action would require planning and zoning Commission and Board of <br />Adjustment approval., <br />In speaking with the Engineer for the IREWCD, Marvin Carter, there is no <br />objection but formal approval should be given. <br />RECON1VDATI0N AND FUNDING <br />It is recommended that <br />1) An appraisal be obtained for the 1,8001.f. x 120' wide right-of-way <br />through Mr. Jenkins property. <br />2) The staff be authorized to work with Mr. Jenkins in negotiating a <br />price to fill the excavated right-of-way area, Mr. Jenkins would have <br />to seek a modification of his mining permit to expand the mining <br />limits and excavate deeper. <br />Funding shall be from Fund 109, Gas Tax Revenue <br />Director Davis confirmed that his recommendation is not to <br />grant a variance. While Mr. Jenkins would like to expand his <br />mining limits, that would have to go through the proper Planning <br />8 Zoning procedures. Staff is recommending that.an appraisal be <br />obtained for the 1,800 1.f, x 120' wide right-of-way through Mr. <br />Jenkins property and that authorization be given for staff to <br />work with Mr. Jenkins in negotiating a price to fill the <br />excavated right-of-way area. <br />ON MOTION by Commissioner Lyons,,SECONDED by <br />Commissioner Wodtke, the Board unanimously (4-0) <br />approved staff's recommendation as set out in the <br />above memo. <br />Commissioner Bowman felt the minus 7.5 mean sea level was <br />just outrageous, and believed that Mr. Jenkins should not be <br />misled on this because nobody is going to give him a permit to do <br />that. She emphasized that there is no necessity to dredge in <br />sand mining. <br />Robert Keating, Director of Planning S Development, <br />explained that Mr. Jenkins' mining operation was approved years <br />and years ago and the Planning staff has been working with the <br />22 <br />
