Off -Street Parking Spaces Required: No additional parking is <br />required <br />6. Access: The guest cottage will be accessed by an existing <br />drive off of Rufner Lane. <br />7. Drainage Plan: A stormwater management permit is not, <br />required, and drainage improvements are not necessary. <br />8. Landscape Plan: Landscaping is not required. <br />9. Utilities: The residence is presently on private well and <br />septic system and the director of Environmental Health has <br />approved expansion of the existing system. <br />10. Surrounding Land Uses: North: Single-family <br />South: Groves <br />East: Vacant <br />West: Single-family <br />11. Guest Cottage Special Exception Criteria (Sec. 25.1) <br />a. Shall be an accessory structure or portion of a <br />single-family dwelling; <br />b. Shall not be located closer than 15 feet to the <br />principal dwelling on the lot; <br />C. No guest cottage may be utilized for commercial <br />purposes; and <br />d. The guest cottage shall only be used for the inter- <br />mittent or temporary occupancy by a nonpaying guest. <br />Section 25.1 of the Zoning Code, Regulations for Specific Land <br />Uses, details specific criteria to be considered when reviewing a <br />guest cottage for approval as a special exception use. All <br />criteria have been met. The special exception process allows the <br />Board of County Commissioners to impose any additional conditions <br />to ensure compatibility of the proposed use with surrounding <br />property. The staff recommends that the applicant be required to <br />execute and file a document in the Public Records that prohibits <br />the said guest facility from ever being rented. This recommenda- <br />tion is to ensure that prospective owners of the subject property <br />will be made aware that the guest facility is not to be considered <br />a rental unit. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners grant <br />special exception approval for the guest cottage with the <br />following condition: <br />1. The applicant shall execute, record and be responsible for <br />any fees associated with recording a document in the public <br />records that forever prohibits said guest facilities from <br />ever being rented. <br />36 <br />
