That was also cleared up <br />by a telegram sent to the County stating that yes he would work <br />with Dean Products. <br />Chairman Scurlock asked Mr. Crosby if he had all this <br />documented, and Mr. Crosby advised that while he did not have the <br />telegram, he could get a copy from Norman Dean or perhaps even <br />the County's copy. Mr. Crosby emphasized that all Schopke wanted <br />to do was to change from one approved subcontractor to another <br />because Willo Products had demonstrated to them a hard, fast <br />attitude that it didn't matter who Schopke wanted or what <br />contractual conditions were needed, they were going to be the <br />subcontractor -- take it or leave it. In addition, there was not <br />only an uncooperative attitude but a total lack of cooperation <br />since day one in negotiating a fair price. Willo claimed Schopke <br />used their price, but Mr. Crosby believed that Willo merely <br />speculated that Schopke used their price in putting together the <br />general contractor's bid. He pointed out that a general <br />contractor is not obligated to use any price submitted to him by <br />a subcontractor. Schopke stuck their necks out because they felt <br />there was a better price out there after reviewing an <br />accumulation of separate, individual sub bids from companies such <br />as Morrow. Further, they felt that Willo's price was way out of <br />line and that Willo was taking advantage of a market because they <br />felt they had a very "in" thing on Phase II of the Jail. <br />Chairman Scurlock asked if it was common practice to stick <br />their necks out in the bidding, and Mr. Crosby answered that it <br />was, and that he had consulted with Mr. Schopke on this. He <br />explained that this is a typical norm and they can stick their <br />necks out because as general contractors they do have rights to <br />negotiate after. This is not meant to be construed as "bid <br />shopping". He wished to point out that at no time did they ever <br />go back to Willo and ask them to lower their price until it was <br />suggested to them by Ben DiPalma a week ago Tuesday in the <br />68 <br />
