In regard to traffic impact, <br />he felt staff has set out a worst case scenario and also felt the• <br />various services that would be available in the proposed center <br />would limit the traffic to some extent as the residents wouldn't <br />need to go outside for these services. He further noted that due <br />to the input from the previous public hearing, where many were <br />opposing the CG and expressing a preference for CL, Vista <br />Properties changed their request, but it now appears the <br />residents have found some undesirable features in the CL. In <br />trying to find a way to overcome the residents' fears, Vista <br />Properties has had prepared and recorded a Declaration of <br />Restrictions on the subject property which would prohibit the <br />following uses: <br />A. Motion picture theaters <br />B. Self-service laundries <br />C. Commercial parking facilities <br />D. Coin-operated amusement establishments <br />E. Automobile parts stores <br />F. Skating rinks <br />G. Bars and lounges <br />H. Billiard halls <br />I. Hotels and motels <br />J. Bowling alleys <br />K. Time-share developments <br />Commissioner Bowman believed "take-out" and "eat -in" restau- <br />rants are permitted, and this was confirmed but it was noted that <br />drive-through restaurants would not be permitted. <br />Attorney Henderson realized theirs is not a popular request, <br />but he pointed out that the applicant is not really asking for a <br />new commercial zone, but merely requesting that they be given <br />back part of the zoning that was taken away from them in 1981. <br />Chairman Scurlock inquired if the OCR zoning does not allow <br />what Vista Properties wants to develop, and Attorney Henderson <br />explained that OCR zoning is already intact on the property <br />adjacent to the existing sales office which is a sizeable parcel, <br />and they intend office uses there.
