Commissioner Wodtke referred to the statement in the Minutes <br />of the Planning & Zoning Commission Minutes of March 13, 1986, re <br />the Miller rezoning request wherein Planner Shearer indicated <br />that he didn't think anything had changed on the subject property <br />in the last three years. He felt we are all aware that Mr. <br />Miller owns Lots 1, 2, 3 and 4 and also the strip in back of <br />them, which was the old railroad right-of-way, and he cannot <br />envision what that property could ever be used for if it was not <br />at least allowed to be included in with Mr. Miller's other <br />property. Also, in the meantime, the County purchased that <br />right-of-way up to the section line at 510/512 so all that <br />property on the north side of CR 512 south of the cemetery now is <br />owned by Mr. Miller, and Commissioner Wodtke believed that is a <br />significant change from 3 years ago. <br />Planner Shearer felt what staff was indicating at that time <br />was that there had been no additiona•I commercial acreage <br />developed since the Comprehensive Plan was adopted. Obviously <br />the ownership situation has changed in the last 21 years. <br />Mr. Miller noted that the railroad property was not zoned, <br />and he is asking that it be zoned. <br />Chairman Scurlock believed that the Planning & Zoning <br />Commission voted unanimously to deny both requests. <br />Mr. Miller felt they didn't know about his agreement with <br />the School Board, and he further noted that they said his <br />property was too low but it is the same as the property on the <br />other side of CR 512. <br />Commissioner Wodtke inquired what staff's reason was to <br />have the zoning on other side of the road and not the same side <br />as Mr. Miller's property. <br />Planner Shearer explained that there was 50 acres of <br />commercial zoning at this location and a 50 acre node, and based <br />on county policy over the last ten years, that was pretty much <br />what had been envisioned when the Plan was adopted.
