JUL 2 3 1986 <br />BOOK 65 FnF 21;6 - <br />TO: The Board of County Commissioners y N� <br />DATE: July 16,1986 <br />SUBJECT: Hunt Property Acquisition/Save Our Coast Program <br />FROM: Bruce Barkett� <br />Assistant County Attorney <br />By Resolution No. 83 -39, -dated May 26, 1983, the Board of <br />County Commissioners of Indian River County authorized <br />condemnation of what was then known as the Howell/Chapman <br />parcel of property as part of the Indian River County North <br />Beach Complex Save Our Coast Proposal to the Department of <br />Natural Resources and the Trustees of the Internal <br />Improvement Trust Fund (Governor and Cabinet). Since that <br />time the State has purchased the Morris and Perlini tracts <br />to the north of the Howell and Chapman parcel .(now called <br />the Hunt parcel) and Indian River County has purchased the <br />Bell Road and Erdo tracts to the south of the parcel: The <br />addition of the Hunt tract's 1,459 feet of beach frontage <br />would give the County an uninterrupted 3,600 feet of beach <br />frontage for operation as a public recreation facility. <br />Negotiations for the <br />purchase of the property from Mr. Flunt <br />have thus far failed. As the attached agenda items <br />indicate, the Department.of Natural Resources and the Board <br />of Trustees of the Internal Improvement Trust Fund have <br />agreed to reserve the maximum amount allowed by statute for <br />the anticipated purchase of the property if the County' is <br />able to either negotiate a purchase or acquire the property <br />by condemnation. Request is hereby made for the following <br />authorization: - <br />1. To acquire two updated appraisals of the parcel in <br />anticipation of an action in eminent domain to condemn the <br />property. <br />2. To proceed with negotiations to purchase the <br />property from Mr. Hunt. <br />3. To file an eminent domain action' to condemn the <br />property. <br />4. To hire, with funds from the Parks and Recreation, <br />outside counsel specializing in eminent domain work if it <br />appears that such counsel would be able to obtain a more <br />favorable judgment (condemnation price) on the property. <br />Assistant County Attorney Bruce Barkett reported that <br />efforts to purchase the property from Mr. Hunt, who has owned <br />this property since 1982, have failed. The State has agreed to <br />reserve the maximum statutory amount for the purchase or <br />condemnation of this beachfront tract, which is #6 on the Save <br />Our Coasts program, if Indian River County commits to either <br />condemning the property or negotiating a purchase directly with <br />83 <br />� s � <br />
