Mr. Hunt. To go ahead with a condemnation on this property, we <br />will have to file our action of condemnation, and go through a <br />trial which will result in a judgment for a condemnation price. <br />At that time we will have to decide whether we want to make up <br />the difference between what the State has pledged and the <br />purchase price. The State's amount is based on appraisals and <br />right now that amount is confidential. <br />Chairman Scurlock asked if we still would have the ability <br />to back out after receiving a judgment, and Attorney Barkett said <br />that it would be, but we would be responsible for attorney fees. <br />He requested authorization to obtain some updated appraisals <br />file the condemnation, proceed with negotiations with Mr. Hunt if <br />that becomes a possibility, and obtain the services of an <br />attorney who specializes in condemnation proceedings. <br />Chairman Scurlock was not in agreement about retaining a <br />special attorney for this matter, but Attorney Vitunac <br />interjected that he felt confident that the County Attorney's <br />office could do this internally up to a certain point, and <br />perhaps all the way, but he would feel more comfortable in having <br />the authorization to go to a specialist in eminent domain if it <br />is found that the County's interest would be better served. <br />MOTION WAS MADE by Commissioner Bird, SECONDED <br />by Commissioner Bowman, that the Board authorize <br />the 4 recommendations as set out in the above memo <br />and obtain outside counsel specializing in eminent <br />domain proceedings at a cost not to exceed $5,000. <br />Under discussion, Acting Administrator Tommy Thomas felt <br />that the County has an advantage in that we have set the pace <br />with our appraisal, and assumed that because of the size of the <br />tract, that the State will be putting up most of the money. <br />Commissioner Bird believed the State's appraisals are <br />somewhere in the $2.75 -million to $3 -million range.
