M <br />Commissioner Bird noted that this phrase goes on to state <br />permits, but Commissioner Bowman believed this is stated in the <br />wrong order and that permits should come first. <br />Commissioner Bowman next discussed the wording on Page 3 of <br />the proposed ordinance where it states "Such body may also <br />require such restorative measures." She felt it should say <br />somewhere "No mitigation shall be allowed with respect to <br />violations of well established mangroves, sand pines, historic <br />and/or specimen trees." Commissioner Bowman emphasized that <br />mitigate means lessen the damage, and there is no way you can <br />mitigate for the removal of such trees; they cannot be replaced. <br />Commissioner Bird felt mitigate can also mean restitution, <br />but Commissioner Lyons felt we don't want to be in the business <br />of selling historic trees. <br />Director Keating felt in this case we are looking at someone <br />already violating the ordinance and whether or not we want to <br />make them do some kind of replacement in addition to the fine. <br />Commissioner Bowman stated that rather than mitigation, we <br />should call for replacement. <br />Commissioner Bowman further noted that she saw no reference <br />6, <br />to the drip line, and Director Keating felt when it is required <br />that a 5' or drip line area be protected, we end up losing more <br />protected trees because if they can't meet that requirement, they <br />take the tree out. That is why staff is trying to provide more <br />flexibility by reducing the area around the tree that would have <br />to be protected. <br />Commissioner Bowman believed we need another ordinance. She <br />was extremely concerned by what they have done to the vegetation <br />on the east side of A -1-A in Brevard County and feared the same <br />thing is happening at the north end of our county because people <br />are completely careless about the native vegetation. They dig it <br />out and and plant lawns, and we have a water problem on the <br />barrier island in that area. She stated that she would like to <br />have an ordinance drafted that would not allow anyone to take out <br />51 <br />BOOK 65 PAGE o�?� <br />
