methods of dust control suitable for the area involved and approved by Owner will be permitted <br />GC 26 POLLUTION CONTROL <br />Contractor shall, at its expense, perform its work so as not to discharge into the atmosphere, any body <br />of water, the ground or groundwater, from any source, smoke, dust or other contaminants in violation of the <br />laws, rules and regulations of all federal, state and local air and water pollution requirements. Contractor shall, <br />at its expense, provide suitable facilities to prevent any such discharges. Contractor shall immediately report <br />to Owner and appropriate authorities any spill of contaminant. <br />GC27 DEBRIS DISPOSAL <br />All debris shall be legally disposed of at licensed disposal site(s) <br />GC 27 EXPLOSIVES AND HAZARDOUS MATERIALS <br />Contractor shall obtain all required federal, state and local permits and licenses and shall be <br />responsible for the safe and proper handling, transportation, storage and use of any explosive or hazardous <br />material brought onto or encountered with in the site. The Contractor will notify the Owner immediately if <br />explosive or hazardous materials are encountered on the site. Contractor shall maintain and post as <br />necessary, Material hazard Data Sheets for all applicable hazardous materials used in the course of the work. <br />In the event that hazardous material is improperly handled or stored by the Contractor or its sub -contractors, <br />which results in contamination of the site, Contractor shall immediately notify the Owner and the appropriate <br />governmental authority and shall take whatever action is necessary or desirable to remediate the <br />contamination at the Contractor's sole cost and expense Contractor shall indemnify and hold harmless the <br />Owner from any expense, action or liability resulting from such contamination and remedial actions. <br />GC 28 LABOR <br />Contractor shall employ only competent and skilled personnel to perform the work. Contractor shall, if <br />requested by Owner, remove from the jobsite any personnel of Contractor who is determined by Owner to be <br />unfit or working in violation of any provision of the Contract. Contractor and all subcontractors shall be bound <br />by and comply with all applicable Federal, State and local laws regarding labor. All work performed after <br />regular working hours, on Sundays or legal holidays, shall be performed without additional expense to the <br />Owner <br />GC 29 SAFETY <br />The Contractor shall be responsible for initiating, maintaining and supervising all safety precautions <br />and programs in connection with the work. Contractor will provide to each worker on the job site the proper <br />safety equipment for the duties being performed by the worker and will not permit any worker on the job site <br />who fails or refuses to use the safety equipment. The Contractor shall provide and maintain all necessary <br />watchmen, barricades, warning lights, and signs and take all necessary precautions for the protection of all <br />persons involved in the work, the public, and all employees or representatives of Owner All work and all <br />equipment, machinery, materials and tools shall be in compliance with and conform to all applicable laws, <br />ordinance, rules and regulations. <br />GC 30 PROGRESS <br />During construction, Contractor shall keep a marked -up and up-to-date set of drawings showing as - <br />built conditions on that site as an accurate record of all deviations between work as shown and work as <br />installed. These drawings shall be available to Owner and Engineer for inspection at any time <br />During construction, Contractor shall keep a marked -up and up -to date set of specifications showing <br />as -is conditions on the site annotated to clearly indicate all substitutions or product selections that are <br />incorporate into the work. These specifications shall be available to Owner and Engineer for inspection at any <br />time <br />If at any time Contractor's actual progress is inadequate to meet the requirements of the Contract, <br />Owner may so notify Contractor who shall thereupon, at its expense, take such steps as may be necessary to <br />improve its progress to meet the approved schedule. If within a reasonable period as determined by Owner, <br />Owner determines that Contractor is not prosecuting its work with such diligence as will assure completion <br />with the times scheduled, the Owner may declare a default of this Contract. <br />35 <br />
