A bond rider from the Surety shall be submitted to the County with each change order that increases <br />the Contract price <br />GC 38 USE OF COMPLETED PORTIONS. <br />The Owner shall have the right to take possession of and use any substantially completed portions of <br />the work. Such use by Owner shall not be construed as constituting final acceptance, and shall neither relieve <br />Contractor of any of its responsibilities under the Contract, nor act as a waiver by Owner of any contract <br />provisions; provided that the Contractor shall not be liable for any repair or maintenance required due to <br />ordinary wear and tear resulting from such use However, if such use increases the cost or delays the <br />completion of remaining portions of work, Contractor shall be entitled to an equitable adjustment under the <br />contract. <br />GC 39 CLEANING UP. <br />Upon completion of any portion of the work, the Contractor shall remove at his own expense from the <br />Owner's property all temporary structures, equipment and surplus materials not required for later stages of <br />work, rubbish, and waste materials resulting from his operations. Contractor shall make its own <br />arrangements, at its own cost, for disposal of rubbish and waste materials. The Owner reserves the right to <br />retain any surplus or salvage materials. <br />CG 40 BASIC REQUIREMENTS PRIOR TO SUBSTANTIAL COMPLETION <br />The following items shall be completed as a condition precedent to substantial completion and prior to <br />a request by the Contractor for inspection for substantial completion. In the event the Contract does not define <br />substantial completion, the following are also conditions for final completion and acceptance: <br />1. All general construction completed and the project components shall be clean and all <br />systems fully functional. <br />2 All mechanical and electrical work substantially complete, fixtures in place, connected, <br />cleaned and ready for use. <br />3. All electrical circuits shall be scheduled in panels and all panels and disconnect switches <br />properly labeled. <br />4 Issuance of all permits and certificates, inspections, and other approvals and releases by <br />governing authorities required for Owner's occupancy and use of the project. <br />5 Project site shall be cleared of Contractor's excess equipment and/or supplies and material. <br />6 All sets of operation and maintenance manuals for all equipment shall have been submitted, <br />as referenced in the technical specifications. <br />7. Manufacturers' certifications and warranties shall be delivered to Owner <br />8 All operations and maintenance manuals for all equipment shall be delivered to Owner <br />9 AH required spare parts, as well as any special devises and tools shall be delivered to Owner <br />10 All keys and blanks shall have been provided. <br />11 Punch list of items required to render the construction services complete, satisfactory and <br />acceptable to the Owner. If the Contract provides for a multi -phased or multi -structure project, a punch list <br />must be developed for each phase or structure. <br />Contractor shall arrange a joint site and project inspection(s) with Engineer for inspection for <br />substantial completion and development of a punch list for the completion of construction services. Said <br />punch list shall be prepared not later than thirty (30) days after the inspection for substantial completion <br />Punch list items recorded as a result of inspections for substantial completion shall be corrected by the <br />Contractor prior to any request for final inspection and acceptance <br />If substantial completion is not obtained at the inspection called by Contractor, for reasons which are <br />the fault of Contractor, any additional cost to Owner for the Engineer or design professional for any <br />subsequent inspections for the purpose of determining substantial completion shall be the responsibility of the <br />Contractor and shall be assessed against the final payment application. <br />GC 41 FINAL INSPECTION AND ACCEPTANCE <br />The following items shall be completed as a condition precedent to a request by Contractor for final <br />inspection <br />38 <br />
