s <br />In determining the appropriate zoning district for this property, <br />the staff considered both the MED and CL, Limited Commercial <br />zoning Districts. The CL district allows a broad range of <br />commercial uses including auto parts stores and veterinary <br />clinics which the staff did not feel were appropriate for this <br />area. The staff feels that the MED district, with its <br />combination of residential, institutional and selected limited <br />retail uses, would be more appropriate. One problem with the MED <br />district is that it requires 20 foot side yard setbacks while the <br />CL district only requires 10 foot side yards. The 20 foot side <br />yard setback would be a problem on the 50 foot wide lots in this <br />subdivision except for the following provision of the zoning <br />ordinance. <br />25 (k) Minimum buildable width. Side yard requirements <br />notwithstanding, all existing lots of record shall be <br />permitted to have side yards reduced in order to allow a <br />minimum buildable width of thirty (30) feet. The thirty <br />(30) foot width shall be located so that the buildable area <br />is centered in relation to the width of the lot, and that <br />side yards of equal width are maintained. <br />Based on the fact that the fifty -foot wide lots in this <br />subdivision are lots of record, they would be guaranteed a <br />thirty-foot minimum buildable width. Based on this provision of <br />the zoning ordinance, the uses allowed in the MED district, and <br />the fact that the properties east and south of the subject <br />property are zoned MED, the MED district appears to be the most <br />appropriate zoning for the subject property. <br />Transportation System <br />The subject property has direct access to 37th Street (classified <br />as a secondary collector street on the Thoroughfare Plan), and to <br />37th Place and 17th Avenue (classified as local streets). The <br />subject property also has access to U.S. 1 (classified as an <br />arterial street). The maximum development of the subject <br />property under the proposed MED zoning could generate up to 1,334 <br />average annual daily trips (AADT). <br />Environment <br />The subject property is not designated as environmentally <br />sensitive nor is it in a flood -prone area. <br />Utilities <br />A County water main is located on 37th Street. City wastewater <br />facilities are available.
