M M M <br />while right-of-way reservations include land that is reserved <br />for future purchase by the County as the need for such <br />right-of-way for road or utility purposes is demonstrated. <br />On July 10, 1986, the Planning & Zoning Commission voted 3-0 and <br />unanimously recommended approval of the proposed ordinance. <br />ALTERNATIVES AND ANALYSIS <br />Expanding the scope of the administrative approval threshold <br />from no increase in impervious surface to a maximum 1,500 <br />square feet of impervious surface will save a considerable <br />amount of time' for applicants since administrative approvals <br />often take no more than one or two days, whereas minor site <br />plan approval may take at least two weeks and sometimes longer. <br />Administrative approvals are authorized only when all ordinance <br />requirements are met, so the change permitting up to 1,500 <br />square feet of impervious surface improvements to be addressed <br />through the administrative permit process will not diminish the <br />County's ability to enforce applicable regulations. <br />The exemption of several improvement requirements for minor <br />site plans, as outlined above, eliminates a cost disincentive <br />for small scale projects. Retaining marginal access easement <br />requirements and implementing a right-of-way reservation <br />requirement enables a small expansion of existing facilities <br />without the expense of constructing public improvements such as <br />sidewalks and access roadways. <br />The proposed ordinance is a good. solution to what has been <br />viewed as excessive County imposed development costs associated <br />with small scale developments, since the costs of paving access <br />roadways and/or sidewalks is eliminated and provisions are made <br />for the orderly construction of marginal access roads and <br />right-of-way dedication when the need for such improvements is <br />demonstrated by the County. <br />RECOMMENDATION <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners approve the proposed site plan ordinance <br />amendments as contained in.the attached ordinance. <br />Commissioner Bird asked how this would relate to a present <br />situation where a car dealership wants to -remodel his sales <br />center under a minor site plan, but they are imposing a <br />restriction that he must sign a letter agreeing not to put any <br />permanent structures within 80' of the highway. <br />Director Keating explained that reason we are not requiring <br />dedication on this right now is that they have a structure there. <br />The policy where there is an existing structure that needs to be <br />dedicated to meet the standard of the Thoroughfare Plan is that <br />in order to protect the county from, in essence, owning part of <br />the structure by requiring the right-of-way, we require the <br />applicant to'enter into a reservation wherein he agrees not to <br />29 <br />AUG 2 0 1986 BOOK 65 uL-IF 456 <br />J <br />
