In addition, mining is a transi- <br />ent, not permanent, use of property. Therefore, it <br />is questionable as to how a mining operation would be <br />assessed in terms of impact fees. <br />CONCLUSION: <br />It is the staff -Is opinion that all applicable procedures were <br />followed in establishing the Sandridge Golf Course impact fee. <br />Because the golf course site plan was reviewed prior to the <br />effective date of the impact fee ordinance, a tentative impact <br />fee estimate was not provided at that time, compounding the <br />issue. All staff actions, however, conformed to established <br />procedures. <br />The basic facts are that the golf course site plan was approved <br />after the effective date of the impact fee ordinance; it is a <br />land development activity generating traffic; and an impact fee <br />is due. Since there is 4o exemption for public projects in the <br />impact fee ordinance, the golf course must pay a fee. The fee, <br />itself, however could be changed if an individual assessment is <br />submitted justifying different characteristics, use patterns, <br />trip rates or other characteristics used to develop the fee. <br />If an individual assessment is submitted, the staff will review <br />it in accordance with the criteria established in the impact <br />fee ordinance. <br />Chairman Scurlock explained that we went with the consultant <br />that did Palm Beach County's traffic impact fee ordinance because <br />it had been tested in court and we wanted to have as few bumps as <br />possible in implementing traffic impact fees. He understood that <br />Palm Beach County charges an impact fee for all recreational <br />activities on a per parking space basis, which is approximately <br />$80, and wondered why we are trying to recreate the wheel when we <br />could use their approach. <br />Public Works Director Jim Davis explained that our county is <br />a little different in that we have 9 road districts and Palm <br />Beach County has only one.
