Legal aid is <br />helping indigents in a civil situation, and he reported that the <br />Bar Association now has an on-going very good legal aid service, <br />where the Bar members must take such referrals at no charge. He <br />continued to argue that the Law Library would not be included in <br />the Court Facilities Ordinance because that is in a separate <br />ordinance; legal aid is also not in that ordinance and, in <br />addition, it is being handled directly. The Statute says that <br />the money shall be expended "as provided by the ordinance. " The <br />ordinance simply says "court facility," and the Judges intended <br />it to mean facilities for the Judges not the Clerk. <br />Commissioner Wodtke asked if Attorney Albrecht was saying <br />that the Judges feel the Clerk is not part of the court system, <br />and Attorney Albrecht stated that they do not think the Clerk's <br />involvement is part of "the court facility." <br />Board members felt that is a narrow interpretation, and <br />Chairman Scurlock believed the people who wrote the ordinance <br />should know more what they intended than the Judges. <br />Commissioner Lyons expressed his feeling that the televised <br />first appearance is very much a part of the courtroom procedure. <br />Attorney Albrecht advised that the Judge did agree part of <br />the video system is court related. <br />Argument continued at length regarding what the ordinance <br />says; what the Judges think it says; and the fact that what they <br />really want is a new courtroom and additional space. <br />OMB Director Baird clarified that the Judges did bring up <br />the courtroom during the budget hearing, and the Board said we <br />did not have the funds this year. <br />Chairman Scurlock noted that we did discuss space require- <br />ments; now is the time to get into a posture to provide the space <br />when needed and that need is close at hand. <br />Commissioner Bird felt we should have some statistics from <br />the Court Administrator Dave Douglas as he is the one who <br />schedules the courtrooms. <br />29 <br />SEP 0 1986 Bao G��.6 <br />
