The Hutchinson Island Planning & Management Plan <br />The Indian River County Code of Laws and Ordinances <br />Chapter 16Q-20 of the Florida Administrative -Code <br />The dock proposed by Applicant Goode (No. 31-124371-4) on Lot <br />11 of Seagrove West Subdivision is to be located in the Indian <br />River Aquatic Preserve and, therefore, is subject to the <br />requirements of Chapter 16Q-20, Florida Administrative Code. <br />Staff was unable to determine if the project proposed by <br />Applicant Goode complies with all requirements of the County <br />Code and Chapter 16Q-20, in that drawings of the project were <br />not submitted with the D.E.R application. If mangrove altera- <br />tion is to occur as a result of dock construction, approval by <br />both the Department of Natural Resources and the County is <br />required. <br />The nineteen (19) dockage projects proposed to be located in <br />Riomar Bay Subdivision, Unit Two, -are to be located within the - <br />City of Vero Beach and are not subject to County Code require- <br />ments. The docks are to be on privately owned bottomlands and, <br />therefore, are not subject to Chapter 16Q-20 requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners author- <br />ize staff to transmit a letter to the D.E.R with the following <br />comments: <br />1) No dock construction shall be permitted by Indian River <br />County for the project proposed by Applicant Goode (No. <br />31-124371-4) until the requirements of all local <br />ordinances related to dock facilities and mangrove pro- <br />tection have been addressed; <br />2) The Department of Environmental Regulation and other <br />appropriate agencies should coordinate with the D.N.R., in <br />that the project proposed by Applicant Goode (No. 31- <br />124371-4) is located within the Indian River Aquatic <br />Preserve and therefore subject to requirements of Chapter <br />16Q-20, Florida Administrative Code; <br />3) The nineteen (19) dockage projects proposed to be located <br />in Riomar Bay Unit. Two are within the City of Vero Beach <br />and therefore are not subject to County Code requirements; <br />4) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of the projects on ecologically significant submerged <br />bottomlands such as seagrass beds in the Indian River; <br />5) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumula- <br />tive'impacts of dockage projects upon the Florida Manatee. <br />ON MOTION by Commissioner Bird, SECONDED by <br />Commissioner Bowman, the Board unanimously (4-0) <br />authorized staff to forward the comments recommended <br />re the above projects. <br />13 <br />BOOK 65 wj-c 746 <br />L_ SEP 16 196 J <br />
