Attorney Henderson explained that they have a problem with <br />the language added by Director Davis which would require that <br />they "provide increased flood protection to the general public." <br />He felt they can demonstrate increased flood protection to a <br />specific site to be used by the general public, but that they <br />would have difficulty showing that they are improving flood <br />protection for other adjoining properties.. He pointed out that <br />the existing ordinance only operates on the premise that you will <br />not cause any adverse impact to adjoining properties,'and he <br />believed they can show that. <br />Chairman Scurlock suggested that Attorney Henderson present <br />this to the Planning & Zoning Commission and get them to <br />recommend a modification which will be brought back to the Board. <br />Commissioner Bird inquired as to Grand Harbor's tentative <br />development schedule, and Mr. Schaub advised that they should <br />have all the permits necessary by October 14th to start even the <br />estuary system, and they hope to be able to pull a land permit <br />after October 14th if they are successful in getting their <br />conceptual plan approved. They are very anxious to get started. <br />ON MOTION by Commissioner Bird, SECONDED by Com- <br />missioner Bowman, the Board unanimously (3-0) <br />directed staff to take the proposed amendment to <br />the Stormwater Management Ordinance to the Planning <br />& Zoning Commission at their October 9th meeting <br />and then schedule a public hearing at the first <br />opportunity. <br />AGREEMENT FOR ENGINEERING SERVICES - I.R.BLVD.
