He believed the liability question <br />has been answered in that we have sovereign immunity. <br />Commissioner Bowman commented that she does object to their <br />collecting money on the causeway and actually carrying on a <br />business at that location. <br />Commissioner Bird noted that we tried this on a trial basis <br />for a year, and he believed that both he and the Recreation <br />Committee feel that, as far as recreation is concerned, that this <br />is bit different than operating a hot dog stand, for instance. <br />It is providing a tremendous recreational benefit to the people <br />of the county, and many people come just to watch. He pointed out <br />that of all the sailboards seen out there, probably 2/3 or more <br />belong to private individuals. The people of the Sailboard <br />Center are there to mainly instruct and look out for their <br />safety, and they also keep the area policed. They are only there <br />in the afternoons from noon till about 5 o'clock, and there is <br />not a big flow of business. It would be very cumbersome to <br />require a person who wants to rent a board to go back up the <br />highway and pay his fee, and Commissioner Bird did not feel it is <br />necessary. He further pointed out that we have a 60 day cancellation <br />clause in the lease. <br />Chairman Scurlock did not feel the actual cash transaction <br />poses any problem. His concern was the long range implications <br />as he felt we would have a difficult time saying no to another <br />business - jet skis, for instance. <br />Commissioner Bird did not believe there is a problem as long <br />as we stay with short term leases, and he felt that jet skis are <br />something quite different and involve a much different liability. <br />Commissioner Bowman felt there should be some regulation <br />limiting this to water related sports. Certainly, she felt we <br />would want to be able to prohibit a mobile hot dog stand or such <br />type enterprises, and Chairman Scurlock believed the Board is <br />saying this is the time to get more specific about the overall <br />picture and set up some rules. <br />s• <br />39 pp <br />SEP 3 0 1986 <br />
