He <br />4 continued that it was their understanding that Gibson at some <br />point in time would be extended down to 9th Street, and he also <br />felt it was a requirement of the Saint Sebastian PUD that they <br />take the crossing at 9th Street across to U.S.1 for their secondary <br />access. Mr. Davis argued that their request is a reasonable one <br />- the county is retaining all this for a drainage and utility <br />easement, and he also did not agree that $40,000 an acre is <br />necessarily a fair market value. <br />Chairman Scurlock asked Mr. Mensing if he knew how the <br />county did acquire this property, and Mr. Mensing advised that it <br />appears in the replat of the A.A.Berry Subdivision in 1913 but <br />whether it was a request of the St. Lucie County Commission at <br />that time or whether it was purchased, he had no idea. It was <br />done at the same time as all of the streets in the original <br />townsite of Roseland. <br />Commissioner Bird believed our policy has been that if it is <br />proven beyond a reasonable doubt that we have no need for the <br />property, we deed it back, but he believed in this case there is <br />a question and we must be very conservative. He would like to be <br />cooperative with Mr. Crippen and possibly allow him the use of <br />the right-of-way in some reasonable fashion, but as far as <br />deeding it to him outright, he believed the property undoubtedly <br />has some value to the Crippens and to the county as well. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Bowman, the Board unanimously (4-0) <br />closed the public hearing. <br />Director Keating commented that the Zoning Code says if <br />property abuts a railroad, there is no setback requirement.
