Public Works Director Jim Davis explained that there was a <br />minor change on Page 12 of the agreement. Under Section 17-A-1 <br />Liability, the second sentence needs to be amended to read: "The <br />consultant agrees to "indemnify and" hold the client harmless..." <br />MOTION WAS MADE by Commissioner Bowman, SECONDED by <br />Commissioner Lyons, that the Board approve the <br />Professional Engineering Services Agreement with <br />Beindorf and Associates for a drainage study of Vero <br />Lakes Estates, as amended by Public Works Director <br />Davis. <br />Under discussion, Commissioner Lyons questioned the spending <br />of $5,000 on a soil survey when there is an existing soil survey, <br />and Director Davis explained that the contract states that the <br />consultant will use the soil conservation service survey to the <br />maximum extent possible. Some percolation tests may have to be <br />done in certain areas in addition to the soil conservation <br />survey, and that $5,000 is an estimate of a maximum not to exceed <br />cost. -We may not need to use any of it, but staff would like the <br />flexibility to do so. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />F.
