IF_ -OCT l <br />1986 <br />Booit 66 PA'i 40 <br />Chairman Scurlock opened the Public Hearing for the south <br />half of Ercildoune Heights Subdivision and asked if anyone wished <br />to be heard in this matter. <br />Attorney George Collins, representing American Medicorp., <br />Inc., owners of Humana Hospital, stated his clients are objecting <br />to being assessed for 6 lots when those lots are actually <br />unplatted property. He confirmed that there is a sewer plant at <br />the corner and there is no access from the hospital onto 140th <br />Street or into Ercildoune, and none is intended. The hospital's <br />long range plans call for access off of Bay Street and U.S. #1. <br />There are no plans to sell the property or make any use of the <br />subdivision's roads. The proposed resolution infers that two- <br />thirds of the owners within the approved area have approved the <br />plan, but his clients own a substantial portion of the property <br />and do not approve of the project. It may be that two-thirds of <br />the owners within the defined area have approved the plan, but <br />certainly two-thirds of -the owners on 140th Street have not <br />approved the plan. He stressed that this is not a voluntary <br />petition, but a County -initiated project. <br />The hospital will not receive any benefits from being included in <br />this project, and he felt it would be a form of gerrymandering to <br />include this property since the hospital property will not have <br />any access onto the subdivision roads. <br />Director Davis pointed out that the hospital owners have <br />indicated that they would not be interested in donating the other <br />35 feet R/W for 140th Street and paying the assessment too. He <br />felt it would be nice to get additional R/W, but we can still <br />perform the paving because we are going curb and gutter. <br />Chairman Scurlock just wanted it made clear that the Board <br />wishes to save whatever trees we can. <br />Attorney Collins believed there is no reason for the <br />hospital to dedicate any R/W because they do not intend to <br />40 <br />M <br />
