This price �t <br />p . would not include extension of utilities to the site or <br />additional fees or charges generated by utility services. <br />It would appear that the logical scenario would be as follows: <br />1. The property has been deeded to Indian River County by the <br />Town of Indian River Shores for the express purpose of the <br />building of a Gifford Community Center. This conveyance <br />included a reverter clause that states, "If the property is <br />not used by Indian River County for a community center by <br />September 13, 1987, the property automatically reverts to <br />the ownership of the Town of Indian River Shores." <br />2. In order to receive the funds and construct the building, <br />the School Board must either have title to the property or a <br />long term lease. The Department of Education indicated that <br />a 40 -year lease from Indian River County to the School Board <br />would satisfy this requirement. <br />3. The School Board would make application to receive the PECO <br />funds and proceed to build the building according to <br />construction plans to be approved by the Board of County <br />Commissioners, the School Board, and the Department of <br />Education. Once the building is completed, the School Board <br />would then void the lease with the County and return the <br />property and all improvements back to Indian River County <br />for subsequent leasing to the Gifford Progressive Civic <br />League. The question was raised both locally and in <br />Tallahassee whether or not the School Board would have the <br />ability to lease the improvements and the land directly to <br />the Civic League when completed rather than working through <br />the Board of County Commissioners. According to Dr. Charles <br />Chick of the Department of Education, the School Board may <br />not lease directly to a civic organization, but is required <br />by law to convey an educational facility only to a <br />governmental entity. <br />4.— The County -would then enter into a lease agreement with the <br />Civic League for a -prescribed period of time during which <br />time the League would assume full maintenance and <br />operational responsibility for the facility. It has been <br />suggested by the League that a separate Board of Directors <br />be appointed by the Board of County Commissioners to oversee <br />the facility and its operations. The League would make <br />recommendations to the Board of County Commissioners from <br />which the Board members for the Community Center would be <br />chosen. <br />Regarding the construction of the building, the estimated cost is <br />$400,000 of which $250,000 is available through PECO funds. The <br />community has to date raised approximately .$20,000 to assist in <br />funding, leaving a shortfall of $130,000 in order to complete the <br />project. There is an anticipation that as much as $100,000 might <br />be available in additional grant funds through the State, and Sam <br />Hunter and League officers are pursuing this at the present time. <br />The remaining $30,000 will likely be made up of additional <br />community fund raising efforts, and a request for financial <br />assistance from the League directed to the Board of County <br />Commissioners and the Indian River County School Board. This <br />request will be discussed in more detail at the forthcoming <br />Commission meeting on October 14, 1986 at 11:00 A.M. Once the <br />building is constructed it is anticipated that the annual <br />operating expenses of the building will run between $18,000 and <br />$21,000 per year as estimated by Dr. Hunter. <br />65 <br />BOOK 66 <br />m,,E 65 <br />
