since the Comprehensive Plan was adopted in 1982, and there has <br />been very littleinterestin this area for further commercial <br />development since the Commercial Node was created in 1984. Due <br />to the fact that the node is less than 1/3 developed, an increase <br />in the amount of commercially zoned land in this area does not <br />seem to be justified at this time. <br />RECOMMENDATION <br />Based on the fact that less than 1/3 of the node is developed <br />commercially at this time, the fact that no commercial <br />development has been approved in this area since the <br />Comprehensive Plan was adopted in 1982, and considering the <br />Planning and Zoning Commission's recommendation, staff recommends <br />that the Comprehensive Plan Amendment application be denied. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />Chauncey N. Hatch, Jr., applicant and owner of property on <br />5th Street SW (Rebel Road) and 27th Avenue, explained that he <br />made the trip from his home in Kentucky just to attend this <br />meeting because it means a great deal to him. He pointed out <br />that the Minutes of the Planning 8 Zoning meeting of September <br />11, 1986, are incorrect as they that state he was present, at the <br />meeting and had nothing to add to sta'ff's recommendation. He <br />wished to state that he was not in Vero Beach at the time, and if <br />he had been, he certainly would have made some objections. The <br />main reason he purchased this land in 1978 is because the front <br />3307feet were zohed commercial, and he believes that he has been <br />discriminated against and treated unfairly for a number of <br />reasons. <br />Referring to a map of the Oslo Road/27th Ave. commercial <br />node, Mr. Hatch pointed out that everyone who has frontage from <br />5th Street SW to Oslo Road, and even property beyond Oslo Road on <br />the west side has been given limited commercial except for him. <br />He could not understand why he should be singled out to be <br />eliminated from the zone and downgraded. Mr. Hatch pointed out <br />that the only objection the P s Z Commission had regarding this <br />matter was that only about one-third of the 50 acres designated <br />as limited commercial has been utilized. He explained that the <br />simple reason for that is because the property owner south of him <br />does not wish to sell. In addition, there are 3 residences on <br />the west side of 27th Ave. before Oslo Road which were originally <br />T 2 119"16 6 3 BOOK 66 raE x.714 <br />
