DeBloisRA <br />REFERENCES: Zito/TM#87-029 <br />Environmental Planning Section DIS:ROLAND <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of October 28, 1986. <br />DEPARTMENT OF ENVIRONMENTAL REGULATION APPLICATION <br />FILE NO. 31-126003-4 <br />- Applicant: Ted Zito <br />c/o Lloyd & Associates, Inc. <br />1835 20th Street <br />Vero Beach, FL 32960 0 — <br />Waterway & Location: The project is located in the Indian <br />River in "North Hole", Section 3, Township 31 South, Range 39 <br />East, Indian River County, Florida. The upland property <br />associated with the project is north of and adjacent to <br />Hallmark Ocean Subdivision on State Road A -1-A, located in the <br />unincorporated portion of the County. <br />Work & Purpose: The applicant proposes to construct a private <br />single T-shaped dock extending 58' waterward, with a 53' x 4' <br />main access pier and 20' x 5' terminal platform (total square <br />footage: 3120. No sewage pump -out or fueling facilities are <br />proposed. No dredging or filling will be performed. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />- The Hutchinson Island Plannin & Management Plan <br />- The Indian River County Code of Laws and Ordinances <br />- Chapter 16Q-20, Florida Administrative Code <br />Review of the County plat map for the proposed project location <br />indicates that the submerged bottomlands of the area are <br />privately owned. In that the project bottomlands are privately <br />owned, it is staff's interpretation that the project is exempt <br />from requirements of Chapter 16Q-20, Florida Administrative <br />` Code, relating to the Indian River Aquatic Preserve. The <br />applicant is still required, however, to verify ownership of the <br />bottomlands with the Department of Natural Resources. <br />16 <br />
