� r � <br />The Indian River County Code of Laws and Ordinances has speci- <br />fic standards and criteria related to the construction of an <br />accessory dock prior to the establishment of a principal <br />structure, part. of which requires site plan review and the <br />posting of a $5,000.00 bond to assure that the dock is not used <br />prior to construction of the principal use. Also, the County <br />has specific requirements related to the alteration of <br />mangroves. Before County approval of the project, the <br />referenced standards and criteria must be satisfied and permits <br />obtained. <br />The extent to which the submerged bottomlands of the proposed <br />project area will be impacted has not been determined; the <br />effect of Indian River development on ecologically valuable <br />seagrass beds should be considered. <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comments regarding <br />this project to the Florida Department of Environmental Regu- <br />lation: <br />1) The Department of Environmental Regulation and other <br />appropriate agencies should coordinate with the D.N.R., to <br />determine if the project as proposed is located in the <br />Indian River Aquatic Preserve and therefore subject to <br />requirements of Chapter 16Q-20, Florida Administrative <br />Code. <br />2) No dock construction shall be permitted by Indian River <br />County for the project until requirements of all local <br />ordinances related to dock facilities and mangrove pro- <br />tection have been addressed. <br />3) The Department of Environmental Regulation and other <br />appropriate agencies should consider the potential cumula- <br />tive impacts of dockage projects upon the Florida Manatee; <br />4) The Department of Environmental Regulation and other <br />appropriate agencies should evaluate the potential impact <br />of the marina project on ecologically significant sub- <br />merged bottomlands such as seagrass beds in the Indian <br />River. <br />ON MOTION by Commissioner Bird, SECONDED by Commis- <br />sioner Lyons, the Board unanimously authorized <br />staff to forward comments to the DER as set <br />out above. <br />O.
