BOOK F�;c. 291 <br />ordinance where reservations are allowed under two circumstances <br />- one where you have a minor site plan, and the other where you <br />ha-ve some existing structures in the area that R/W would be <br />acquired. R/W dedication always has been a problem, and he <br />believed the R/W widths in this are minimums. In addition, in <br />the last year, methods have been developed which make it a lot <br />fairer, i.e., where you get credit on your impact fees if you <br />donate R/W and also being allowed to use the R/W in computing <br />overall density. <br />Commissioner Wodtke continued to express concern about <br />agricultural areas in which there is some residential and the <br />problems involved with the requirements of the drainage district <br />on R/W. <br />Chairman Scurlock felt it would be much simpler to pay <br />everyone for the R/W we take. It is too confusing now, and he <br />felt we are inconsistent - some are donating R/W and some are <br />being paid top dollar. <br />Public Works Director Davis believed that timing is an <br />important issue. If the county is ready to move in a certain <br />corridor, we get a mixture of different R/W acquisitions. It a <br />paving petition is submitted and we have a large majority <br />consenting, then we try to get as much R/W donated as is needed <br />for those improvements. <br />Director Keating advised that the Legislature passed a law <br />last year that allows for road reservations but there are a lot <br />of limitations; the reservation is only good for five years, and <br />people are allowed to challenge you in court and sue. He <br />believed that a lot of our needs are 40-50 years down the road. <br />Commissioner Lyons emphasized that this matter of reserving <br />R/W is of extreme importance to this county, and he felt we <br />should go to our legislative delegation about this. <br />Chairman Scurlock agreed there is no question we must <br />reserve the R/W, and the only question is who pays for it. <br />32 <br />i1mi7-7 <br />
