Nearing <br />REFERENCES: <br />Freeman <br />Staff <br />Planner <br />DAVE3 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of October 28, 1986. <br />DESCRIPTION AND CONDITIONS: <br />Mr. and Mrs. William Freeman have submitted a right-of-way aban- <br />donment petition requesting that the County abandon that portion <br />of 21st Street located between 53rd and 54th Avenues north of S.R. <br />60. That applicant is requesting this abandonment due to the fact <br />that this portion of right-of-way has not been improved in any <br />way. <br />The petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way, as per <br />guidelines established by the Board of County Commissioners for <br />processing right-of-way abandonment *applications. All reviewing <br />agencies, which included the Public Works Division, the Utilities <br />Division, Florida Power and Light and Southern Bell, recommended <br />approval of the petition for abandonment. However, the County <br />Public Works and Utilities Departments as well as several other <br />utility providers have requested that the south 37.5 feet of this <br />parcel proposed for abandonment be granted to the County as a <br />drainage and utilities easement. The petitioners are in agreement <br />with the request. <br />ANALYSIS <br />The 50 ft. wide unimproved right-of-way is not part of the roadway <br />system noted on the County Thoroughfare Plan, and its need as such <br />is not anticipated. Because this area is already substantially <br />built -out and the need for this portion of 21st Street has not <br />arisen, it is staff's opinion that the County has no use for the <br />-property, and does not ever foresee its use. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the 50 foot <br />wide portion of 21st Street right-of-way, with the exception of <br />the requested drainage and utilities easement, and authorize the <br />Chairman of the Board of County Commissioners to execute the <br />attached resolution (Attachment #3). <br />The Chairman asked if anyone present wished to be heard. - <br />There were none. <br />I <br />48eoo� �6 Fn -248 <br />OCT 8 <br />
