rgCT 2 8 1996 <br />BOOK 66 <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Wodtke, the Board unanimously closed the <br />public hearing. <br />ON MOTION by Commissioner Lyons, SECONDED by Com- <br />missioner Bowman, the Board unanimously approved <br />Resolution 86-96 abandoning that portion of 21st St. <br />lying east of 54th Avenue and west of 53rd Avenue <br />within the EI Vero Villa Subdivision as requested by <br />William Freeman. <br />RESOLUTION NO. 86-96 �, , � uCr1986 <br />C111 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIO S'.,• Off'' :.INDI <br />RIVER COUNTY, FLORIDA PROVIDING FOR THE CLOSING, AB 0 -MINT, <br />VACATION OF THAT PORTION OF 21ST STREET LYING EAST 0'. �i V <br />AND WEST OF 53RD AVENUE WITHIN THE EL VERO VILLA SUB AS <br />RECORDED IN PLAT BOOK 4, PAGE 97 OF THE OFFICIAL RECORDS OF ST. <br />LUCIE COUNTY, AND RESERVING UNTO THE COUNTY AN EASEMENT FOR <br />DRAINAGE AND UTILITY PURPOSES. <br />WHEREAS, on January 13, 1986, the County received a duly <br />executed and documented petition from Mr. and Mrs. William <br />Freeman, 2105 53rd Avenue, Vero Beach, Florida, requesting the <br />County to close, vacate, abandon, and disclaim any right, title, <br />and interest of the County and the public in and to all that <br />portion of 21st Street lying east of 54th Avenue and west of 53rd <br />Avenue within the El Vero Villa Subdivision as recorded in Plat <br />Book 41 Page 97 of the Official Records of St. Lucie County, and <br />reserving unto the County an easement for drainage and utility <br />purposes; and • <br />WHEREAS, in accordance with Florida Statutes 5336. 10, notice <br />of a public hearing to consider said petition has been duly <br />published; and $ <br />WHEREAS, after consideration of the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said right-of- <br />way is not a state or federal highway, nor located within any <br />municipality, nor is said right-of-way necessary for continuity of <br />the County's street and thoroughfare network, nor access to any <br />given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- <br />SIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the <br />public in and to that certain right-of-way being known more <br />particularly described as: <br />ALL THAT PORTION OF A ROAD RIGHT-OF-WAY KNOWN AS 21ST <br />STREET AS DESIGNATED ON THE PLAT OF EL VERO VILLA SUB AS <br />RECORDED IN PLAT BOOK 4, PAGE 97 ON THE OFFICIAL RECORDS <br />OF ST.
