S <br />03v. o <br />U,ilities -- <br />Finance <br />Other <br />We are hereby requesting to be placed on the agenda of the <br />County Board of Commissioners meeting on October 28, 1986. <br />The purpose of our request is to discuss the issue of <br />Paragraph Six (6) in the Developer's Agreement (copy <br />enclosed). <br />We believe that it was the County's concern for potential <br />traffic problems for imposing the 750 occupancy restriction. <br />Since the center has opened, the traffic has been monitored <br />by the Indian River County Sheriff's Department. Lt. <br />Attkission and Major Raymond have acknowledged that the <br />shopping center is not generating a noticeable increase in <br />traffic at this time and don't anticipate a problem in the <br />future. <br />Ryanwood Shopping Center is currently 650 leased and will <br />soon be 65% occupied. It has become public knowledge that we <br />have a 75% limitation and as a result, has delayed and, in <br />some instances, has prevented the execution of our pending <br />leases, as the prospective tenants fear they will be restricted <br />from opening on a timely basis. This restriction has not <br />only developed into a major handicap for us, but also for the <br />business people from Indian River County. With our concern, <br />as well as yours for public safety, we feel there should_ be <br />no problem in removing this restriction from the Developer's <br />Agreement; especially in view of the fact that we still <br />maintain a deposit and our commitment to provide traffic <br />patrol, as necessary, to insure the -safety of the patrons and <br />passers-by. <br />In anticipation of your cooperation "in this matter, we would <br />like to take this time to thank you and look forward to <br />discussing this with you at the meeting on October 28, 1986. <br />Sincerely, <br />MURRAY ENTERPRISES, INC. <br />imberly F.
