get that first floor up so they do not cut down what is on top of <br />the dune. <br />Commissioner Bowman felt strongly that we don't set things <br />just so we accommodate the scofflaws, but Commissioner Lyons felt <br />they are a fact of life that must be faced. <br />Discussion continued re 11' setback for 1' of height, which <br />would require a setback of 15' to go up 101, and Attorney Stewart <br />agreed that would work for them as long as there was still a <br />maximum cap of 10' height increase. <br />It was determined that no one further wished to be heard. <br />ON MOTION by Commissioner Bird, SECONDED by Com- <br />missioner Lyons, the Board unanimously closed the <br />public hearing. <br />Commissioner Bird reviewed the history of creating this <br />vehicle after reaching a compromise with Mr. Nutt. He did not <br />share everyone's concern about a leapfrog situation since this is <br />the only piece of property zoned for hotels on the barrier <br />island, and he believed over the years we have become more <br />restrictive in our rezoning rather than less. <br />MOTION WAS�MADE by Commissioner Bird, SECONDED by <br />Commissioner Lyons, to adopt Ordinance 86-72 with <br />the amendment that for every 11' of setback 1' in <br />height would be allowed up to a maximum of 45' and <br />this can only occur within the CG zone. <br />Commissioner Wodtke felt this would result in something very <br />similar to the height allowed in Indian River Shores. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried 4 to 1 with <br />Commissioner Bowman voting in opposition. <br />4 1986 <br />31 <br />BOOK <br />66 PACE 313 <br />
