WASTEWATER SERVICE AGREEMENT <br />THIS AGREEMENT made this 4th day of November , <br />1986, by and between INDIAN RIVER COUNTY, a political subdivision of <br />the State of Florida, hereinafter referred to as "County," and <br />FLORIDA CONVALESCENT CENTERS, INC., a Florida corporation, <br />hereinafter referred to as "Customer." <br />W I T N E S S E T H: <br />WHEREAS, the City of Vero Beach and County entered into a <br />temporary wastewater capacity transfer agreement on the 6th day of <br />July, 1984, transferring 100,000 gallons per day of wastewater <br />capacity from the South County Mainland wastewater service territory <br />to the County's Hospital Node; and <br />WHEREAS, Customer is constructing a convalescent center on <br />property within the Hospital Node in the water and sewer service <br />area of the County and is in need of sewer service; and <br />WHEREAS, the County is not in a position, at this time, to <br />supply sewer service to Customer, and desires to prevent the <br />proliferation of private package wastewater treatment plants; and <br />WHEREAS. Customer and County desire that the City service <br />Customer with a limited amount of sewer service on a temporary <br />basis; and <br />WHEREAS, it is now. the intention of the County to formally <br />authorize the use of a portion of the temporary wastewater capacity, <br />under the following terms and conditions: <br />1. It is understood between the parties that this is a 10,600 <br />G/P/D temporary allocation of wastewater capacity, provided by <br />the City of Vero Beach. <br />2. Customer shall pay all fees required by the City of Vero <br />Beach. <br />3. The design and construction of the wastewater improvements <br />that will provide service to Customer's property shall meet <br />County requirements. <br />9 Boa b6 <br />1V 4 1986 - <br />
