�T <br />NOV <br />18 1 <br />BOOK45 <br />,,.. <br />but pine trees and palmettos; <br />the only trees taken out were in <br />the house pad area; and he did not tell his operator to take out <br />the pine trees, just to underbrush. They did get permits for <br />-- burning. Mr. Ward stated that he did realize you have to get <br />permits to take out trees, but believed Indian River County is <br />about the only county requiring that. He mainly works in St. <br />Lucie County, and their company basically does large scale <br />clearing and very little lot clearing. Mr. Ward emphasized that <br />he is very familiar with land clearing; he does know what he is <br />authorized to do; and they did not go there to clear out a bunch <br />of trees. <br />Discussion ensued at length regarding the location map <br />submitted by staff, what locations were cleared, whether the 16 <br />pine trees were all removed just from the building site, and <br />whether there was a requirement to do a drainage ditch. <br />Planner DeBlois advised that he saw groupings of trees <br />laying in various locations, but possibly they could have been <br />moved there in preparation for burning. <br />Director Keating noted that the only drainage requirement is <br />that you don't impact your neighbor's property with your <br />drainage. <br />Chairman Scurlock asked if trees were removed when they <br />cleared for the drainage ditch, and Mr. Fuster stated that some <br />were, but they stopped when they got the letter from staff. <br />The Chairman asked if the Fusters have a building permit <br />which sets out what they are going to do. <br />Mr. Fuster advisred that they do not have a building permit <br />yet; they are just clearing. They did not get the permit because <br />the property is so dense they didn't even know exactly where they <br />could put the house, and they had to clear in order to get a <br />survey. <br />Planner DeBlois advised that the Tree Protection ordinance <br />has an exemption.for clearing of a path for a survey; however, <br />80 <br />s � s <br />
