the exemption is for land clearing only and does not refer to <br />removal of protected trees. <br />Director Keating noted that a tree survey must be submitted - <br />so we know where the protected trees are, and Chairman Scurlock <br />felt the drainage also requires a plan and should not be done <br />before review by staff. <br />Mr. Fuster stated that they have not done the drainage; they <br />have only cut the path. <br />Commissioner Wheeler felt part of the problem is obviously <br />lack of communication. He did believe that the clearing was done <br />quite innocently. <br />Mr. Fuster informed the Board that he is new in the county <br />and he was quite impressed when he initially called the County <br />Building & Zoning Department because the people were very <br />helpful. He had felt they were following the right steps, and <br />assured the Board they are not trying'to circumvent anything. <br />Commissioner Bird believed if the Fusters had gone through <br />the proper channels, they legally could have removed trees from <br />the house pad, and Director Keating agreed, but noted we would <br />have required a tree survey and if they had the survey, staff <br />possibly would have recommended shifting the building envelope <br />area. He also doubted staff would recommend the remov-al-of trees <br />for a drainage ditch all the way through the property. <br />Chairman Scurlock asked Mr. Ward's operator if all 16 trees <br />that staff counted came from within the area of the house pad, <br />and he confirmed that they did. He again emphasized the property <br />contains many thousands of trees, and Mr. Fuster informed the <br />Board that they did move the site a couple of times because the <br />operator would not remove oak trees. <br />Mr. Ward stated that he has been involved in land clearing <br />most of his life; he is very conservative and does understand the <br />whole point of the issue.
