He continued <br />that due to the fact he believed there was some miscommunication <br />and that the trees apparently did come from the house pad area <br />and probably would have been allowed to be removed, there should <br />be some modification of the fine recommended by staff. He did <br />not feel we can entirely disregard the violation because we have <br />had many similar situation where we have had fines. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Wheeler, to levy a fine of $500 against <br />the property owner and have him pay triple for an <br />after -the -fact permit. <br />Mr. Fuster wished to recommend that when anyone calls and <br />says they are building a single house, that staff not say you <br />don't need us. <br />Commissioner Bird agreed we must be sure staff dispenses <br />accurate information, and Director Keating felt a lot depends on <br />how a question is phrased. <br />Chairman Scurlock believed that people should be encouraged <br />to come in rather than getting information over the telephone. <br />Commissioner Bowman wished to point out that you are not <br />only prohibited from cutting trees, but you are not permitted to <br />underbrush without a permit. This property is pine/pond land and <br />she sincerely doubted you could knock down 16 trees in the area <br />of a house pad. She emphasized that ignorance of the law is no <br />excuse. <br />Director Keating stated that staff did send letters to every <br />land clearer as directed by the Commission. <br />Chairman Scurlock noted that the Motion deals with the <br />property owner, but he did not feel it is fair to penalize only <br />the owner who hires professionals to do his clearing. <br />82 <br />
