Davis, P.E., <br />Public Works Director <br />DESCRIPTION AND CONDITIONS <br />SUBJECT: Right -of -Way Acquisition - <br />14th Street between US 1 and <br />6th Avenue <br />REFERENCES: <br />In 1982, the County received a petition to pave a portion of 14th Street <br />between 6th Avenue and the Council on Aging building. To extend the <br />pavement further westward to USI, staff attempted to acquire a donation of <br />25' of road right-of-way along 14th Street between the Council on Aging and <br />US 1. Staff was unsuccessful to acquire the right-of-way, so this section <br />was left unimproved. Mrs. Grace Lacava, owner of a single family home on <br />14th Street, retains ownership of the south 25' along 14th Street in this <br />area. As a result of inadequate right-of-way, the Road and Bridge Depart- <br />ment has not maintained this unpaved section of 14th Street. Large holes <br />in the unimproved dirt road have been exposing County water and sewer lines <br />and manholes. Recently, a car was badly damaged when it hit -a County sewer <br />manhole. <br />ALTERNATIVES AND ANALYSIS <br />The County Public Works Department and Utilities Department are concerned <br />that if this section of 14th Street remains open to traffic between US 1 <br />and the Council on Aging, utility lines and manholes will be damaged unless <br />the County begins to properly maintain the road. The alternatives present- <br />ed by staff include: <br />1) Close the road to traffic just east of the Clock Restaurant. Various <br />residents may object to this alternative. <br />2) Authorize the County Road and Bridge Department to maintain the road, <br />regardless of right-of-way availability. This road has been in <br />existence for the past 20 years and serves a number of property <br />owners. After four years of continued maintenance, the County could <br />file a maintenance map as authorized in Florida Statutes. Mrs. Lacava <br />may contest this action. <br />3) Authorize staff - to once again, communicate with Mrs. Lacava and <br />request donation or sale of the right-of-way. If this effort is not <br />successful, proceed to have an appraisal obtained and condemn the <br />right-of-way. Once right-of-way is acquired, the road should be <br />Properly paved via special assessment. <br />RECOMMENDATION AND FUNDING <br />Staff recommends Alternative #3 so that the right-of-way acquisition and <br />paving can be initiated. Funding to be from Gas Tax Revenue and Petition <br />Paving Fund 703. <br />30 <br />
