F-7 - <br />DEC 2 <br />7BOOK <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />Allen Ballard, 1974 5th Court, S.E., reported that in <br />response to a ballot he mailed out, he received 13 votes in <br />opposition to the street lighting district and 3 votes in favor <br />of it; however, most of the people who responded said that they <br />had not received any notice of the proposed taxing district. <br />Commissioner Bird wanted to know what procedures were used, <br />and Assistant County Attorney Jim Wilson explained that a letter <br />was received from the Vero Shores Homeowners Association <br />requesting the MSTU. Since it appeared to be a legitimate <br />request by people authorized to do so, staff went ahead and put <br />the budget together for the taxing district. The only contact has <br />been with the Homeowners Association. <br />Commissioner Bird felt that perhaps our procedure should be <br />changed, but Attorney Wilson noted this is the first time there <br />has been any objection to a request for --the establishment of a <br />street lighting district. <br />County Attorney Charles Vitunac recommended that in the <br />future anyone wishing to establish a street lighting district <br />meet first with the County Administrator. <br />William Davenport, Sr., President of the Vero Shores <br />Homeowners Association, emphasized that this matter has been <br />discussed at everyone of their past four general meetings, and on <br />each occasion he has been directed to get it before the County <br />Commission for approval. He noted that Mr. Ballard attended one <br />of those meetings and felt that Mr. Ballard had circulated <br />misinformation about the cost of the district along with his <br />ballots. Mr. Davenport reported that OMB Director Joe Baird had <br />answered every question he had asked and done everything he could <br />to assist them in this matter. The residents of Vero Shores have <br />been trying for 5 years to get the subdivision lighted. Based on <br />information from FP& L, the cost is estimated at $30 for each lot <br />for the first year and $24 a lot thereafter. <br />39 <br />
