JAN <br />13 <br />1987 <br />BOOK <br />66 <br />F- E S 6 <br />Chairman Scurlock understood that <br />in connection with <br />this <br />plan, Ralmar has submitted plans for a standard tract subdivision <br />to the Planning Department. <br />Mr. Boling advised that the standard subdivision site plan <br />approval is going before the Planning & Zoning Commission on <br />January 22, 1987. <br />Chairman Scurlock asked at what point the application for <br />the standard subdivision would become vested, and Attorney <br />Vitunac stated that the developer would be vested whenever he has <br />some County approval of his project such that he can be assured <br />that he can rely on that and proceed. The approval could be from <br />the Planning & Zoning Commission, but even a denial from the P & <br />Z would allow him to seek remedy in the courts. <br />Commissioner Wheeler asked the status of the RS -2 zoning <br />district, and Planning & Development Director Robert Keating <br />explained that it was approved last week at the Planning & Zoning <br />Commission and is being advertised for a public hearing before <br />this Board. If the ordinance creating the RS -2 district is <br />approved, a separate public hearing would have to be held in <br />order to rezone the subject area to RS -2. <br />Chairman Scurlock understood that the Board's options today <br />are to approve the PRD as submitted, approve it with conditions, <br />or deny it. <br />Chairman Scurlock opened the Public Hearing and asked if. <br />anyone wished to be heard in this matter. <br />Bennett Rabin, attorney representing Ralmar Associates, <br />Inc., reviewed at great length and in great detail the <br />chronological list of events leading up to this PRD hearing. He <br />recalled that back in September when this Board denied Ralmar's <br />request for RS -6 zoning and changed the zoning to RS -3, it was <br />suggested that a good way to utilize the RS -3 was to go through <br />the Planned Residential Development (PRD), and Ralmar met with <br />engineers, county staff and worked on the PRD concept that is <br />being presented tonight. He advised that Ralmar also met with <br />38 <br />
