,JAIL <br />BOOK —67 <br />F a ,E <br />INDIAN RIVER COUNTY ORDINANCE NO. $7-13 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING ORDINANCE NO. 80-5 <br />BY INCREASING THE AUTHORIZED MILLAGE <br />OF THE NORTH INDIAN RIVER COUNTY FIRE <br />DISTRICT BY ONE-IIALF MILL RESULTING IN <br />A MAXIMUM OF ONE MILL; AUTHORIZING A <br />REFERENDUM ELECTION; PROVIDING AN EFFEC- <br />TIVE DATE. <br />WHEREAS, the North Indian River County Fire District <br />was created by Ordinance No. 80-5; and <br />WHEREAS, pursuant to that ordinance, a referendum . was <br />held in which the voters of the District approved a millage levy <br />not to <br />exceed one-half <br />mill <br />upon all <br />real and tangible property <br />within <br />the boundaries of <br />the <br />District; <br />and <br />WHEREAS, the North Indian River County Fire District <br />Advisory Board has recommended that the authorized millage be <br />Increased from one-half mill to one mill; and <br />WHEREAS, such an increase can be accomplished only if <br />approved by the governing bodies of the municipalities in the <br />District and by the voters within the District by Referendum; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />SECTION 1. INCREASED MILLAGE AUTHORIZED <br />Section 21-34, "Referendum Election Required," of the <br />Indian River County Code, which reads as follows: <br />"Section 21-34, Referendum Election Required. <br />Notwithstanding any provision to the contrary herein, <br />this ordinance shall not. take effect until a referendum election <br />shall have been held wherein the voters resident within the said <br />Fire District have authorized the assessment of a millage levy not <br />in excess of one-half mill by the governing board of the said <br />District upon all real and tangible property within the boundaries <br />thereof and for its support, pursuant to Section 9(b), Article VII <br />of the Florida Constitution of 1968, as amended, and Section <br />125.01(5)(c), Florida Statutes. Such election shall be held on <br />March 11, 1980." is repealed and replaced as follows: <br />"Section 21-34, Authorized ,',tillage <br />The North County Fire District is authorized to levy an <br />4 <br />ad valorem property tax not in excess of one mill per year to raise <br />funds for the support of the district." <br />
