Chairman Scurlock questioned the enforcement issue, and <br />Assistant County Attorney Bruce Barkett explained that for new <br />construction, it will be enforced through a night-time inspection <br />prior to the permit being issued; otherwise, it will be dealt <br />with just the same as every other zoning or Code Enforcement <br />violation. <br />Chairman Scurlock asked it the Game or Freshwater Fish <br />Commission or the Marine Patrol would have the ability to cite <br />someone under this ordinance, and Attorney Barkett advised that <br />while they would have the ability to report a violation, he did <br />not believe they are empowered to enforce County ordinances. <br />Commissioner Wheeler asked if this could be set up as a <br />regular ordinance instead of an amendment to the zoning ordinance <br />whereby the Game and Freshwater Fish and Marine Patrol, along <br />with the Sheriff, would have the ability to write a summons for <br />violations. <br />Attorney Barkett advised that the Sheriff can write a <br />summons now, but practically speaking, he did not believe that we <br />would be able to get Game and Freshwater Fish or the DNR to <br />enforce the ordinance no matter what we do. <br />Attorney Vitunac noted that even the Sheriff finds it <br />difficult to enforce a zoning ordinance because his men do not <br />have a copy of them and don't understand all the technical <br />aspects. By coordinating with the County, however, they can <br />learn how to enforce specific ordinances such as this. <br />Chairman Scurlock explained that the reason this is in the <br />zoning portion is because one of the mechanisms we are going to <br />use is the site plan process. <br />Commissioner Bird felt that we are going to have to provide <br />the enforcement tools within our own Code Enforcement Department, <br />instead of relying on state or federal agencies for enforcement. <br />Commissioner Wheeler felt this would be a lot simpler and <br />quicker if a law enforcement officer could write up a summons for <br />a violation just like they do for other violations, but Chairman <br />19 �An� <br />,FEB Q 800 Fri r. <br />
