to take some time, possibly three to four months, and Attorney <br />Vitunac requested that we also warn them not to bury anyone in <br />the 19 acres presently encumbered by the recreation reverter <br />until this is resolved. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously instructed <br />Attorney Vitunac to write the Winter Beach Cemetery <br />Association as above, indicating a time period of <br />120 days. <br />HOWELL-CHAPMAN RESOLUTION <br />Attorney Vitunac reviewed the following memo, noting that <br />the Resolution is needed to take this to court: <br />TO: The Board of County Commissioners <br />DATE: February 11, 1987 <br />SUBJECT: Howell -Chapman Resolution <br />FROM: Bruce Barkett� <br />Assistant County Attorney <br />On May 26, 1983 the Board of County Commissioners adopted <br />Resolution No. 83-39 authorizing the County Attorney to <br />acquire by purchase, donation or eminent domain proceedings <br />five oceanfront parcels of property deemed necessary for <br />public recreational purposes. Four of the parcels (Bell <br />Road, Erdo, Golden Sands, and Stanny) have been acquired by <br />the County. In addition, the State has purchased three <br />other parcels (Morris, Perlini, and Number Eleven <br />Corporation). <br />The only parcel mentioned in Resolution No. 83-39 which has <br />not been acquired by the County is the "Howell and Chapman' <br />parcel. On December 10, 1986 this Board authorized me to <br />offer the seller $2.7 million fo-r the property, $2.5 million <br />of which were to come from the Save Our Coast fund. Our <br />offer expired on January 9, 1987, and even though I received <br />a letter from the seller on February 4th which indicated he <br />was still considering our offer, 1 request permission to <br />proceed with condemnation proceedings. The Howell and <br />Chapman parcel, consisting of 1459 feet along the <br />oceanfront (19.7 acres), lies between two tracts purchased <br />by the State and two tracts purchased by the County. _ <br />Acquisition of the parcel would give County residents access <br />to a continuous stretch of oceanfront property approximately <br />3,700 feet long. <br />73 <br />EB f' oo7 BOOK <br />
