FEB 17 190 <br />BOOK �rl F,AUC <br />10: The Board of County Commissioners <br />DATE: February 11, 1987 <br />SUBJECT: Winter Beach Cemetery Property Dedication <br />FROM: Bruce Barkett`� <br />Assistant County Attorney <br />At its January 13, 1987 meeting, the Board of County <br />Commissioners directed staff to obtain further information <br />concerning the property on Oslo Road and 20th Avenue which <br />is under consideration for purchase by the County. <br />Specifically the Board wanted to know whether such property <br />would satisfy the State and Federal Agencies involved with <br />regard to transfer -ring the recreation reverter clause <br />presently encumbering the 19 acres the County has dedicated <br />to the Winter Beach Cemetery Association. The Board <br />requested an update after one month. <br />On Monday, February 9th, Mr. H. Jon Hornquist, of Mayes, <br />Sudderth S Etheredge, Inc., Engineers, - Architects & <br />Planners, reported to staff and. Commissioner Bird that his <br />study of the 40 -acre parcel at Oslo Road and 20th Avenue was <br />incomplete, and that he needed further details before he <br />could complete his study for the uses of said property. <br />The application to DNR must contain a legal description of <br />the _specific property to be encumbered by the recreation <br />reverter clause, an appraisal of the property to be <br />substituted, a physical description of the property to be _ <br />substituted, including topography, geological features, and <br />species diversity. Until the design study is completed, we <br />cannot make application to DNR because we cannot <br />specifically describe which portion of the 40 acres will be <br />dedicated to recreation or obtain the required information <br />on the specific portion. <br />It is recommended that this matter be continued until such <br />time as the requisite information is available to staff. <br />Commissioner Eggert asked if we didn't have to put up some <br />land that wasn't recreational against the swap for the cemetery <br />property, and it was explained that the property is going to be <br />acquired for recreational purposes to replace the other; it is <br />not recreational yet. <br />Commissioner Bird believed it would qualify for a substitu- <br />tion - he clarified that we can't.take something we already have <br />in recreation and trade it, but we can take something newly <br />acquired. <br />Chairman Scurlock felt we should indicate to the Winter <br />Beach Cemetery Association in writing that this process is going <br />72 <br />
