Commissioner Bowman disagreed with Attorney O'Haire about <br />this having no use to the County because she believed open spaces <br />such as this are going to be invaluable as more and more people <br />move in and we start looking like Ft. Lauderdale. <br />Attorney O'Haire agreed that if the County has a legitimate, <br />foreseeable use for this, then it should be retained. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter. <br />Michael Walter of Coastal Technology Corporation, concurred <br />with staff's recommendation, and felt it is in the County's <br />interest for tax generation purposes to have the abutting <br />property owners regain their interest to this pr-operty. He urged <br />the Board's approval of the abandonment. <br />There being no others who wished to be heard in this matter, <br />the Chairman declared the Public Hearing closed. <br />Utilities Director Terry Pinto pointed out that we do not <br />have easement rights down the streets of Oceanaire Heights <br />Subdivision, and suggested that if we give that easement back, <br />we have the owners agree that the County will have a 10 -ft. <br />easement for drainage and utilities. He felt that would be an <br />equitable exchange for abandoning the right-of-way. <br />Chairman Scurlock agreed, because if we were to put <br />utilities in there, it would be out front, not in the back. <br />Mr. Nearing explained that the easement along the rear lot <br />line is a continuation of an easement which runs along all rear <br />lot lines in Oceanaire Heights Subdivision; therefore, that <br />easement is necessary for drainage. <br />ON MOTION by Commissioner Eggert, SECONDED <br />by Commissioner Bird, the Board unanimously adopted <br />Resolution 87-21, providing for the closing, abandon- <br />ment, and vacation of a parcel of right-of-way known as <br />Azalea Lane, reserving unto the County an easement for <br />drainage and utility purposes; and specified that the <br />County retain easements for drainage and utilities. <br />25 <br />FEB 2A 1987 <br />BOOK 67 rvIJE400 <br />
