FEB <br />24 <br />1967 <br />BOOK <br />Mr. Walter asked for clarification of <br />the Motion, <br />and <br />it was <br />explained that the easement being required in front of the <br />property is for the purpose of both drainage and utilities. <br />RESOLUTION NO. 87 - 21 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA PROVIDING FOR THE CLOSING, ABANDONMENT, AND <br />VACATION OF A PARCEL OF RIGHT-OF-WAY KNOWN AS AZALEA LANE LYING <br />EAST OF SEAGRAPE DRIVE, SOUTH OF LOT 1, BLOCK F, OCEANAIRE HEIGHTS <br />SUBDIVISION UNIT 2, NORTH OF LOT 9, BLOCK A, OCEANAIRE HEIGHTS <br />SUBDIVISION UNIT 1 AND WEST OF THE WEST LINE OF SUMMERPLACE <br />SUBDIVISION UNIT 3, RESERVING UNTO THE COUNTY AN EASEMENT FOR <br />DRAINAGE AND UTILITY PURPOSES. <br />WHEREAS, on October 24, 1986, the County received a duly <br />executed and documented petition from Coastal Technology <br />Corporation, 800 20th Place, Suite #6, Vero Beach, Florida, <br />requesting the County to close, vacate, abandon, and disclaim any <br />right, title, and interest of the County and the public in and to <br />all that portion of Azalea Lane being within Oceanaire Heights <br />Subdivision, Unit 1, as recorded in plat book 3, page 84, of the <br />Official records of Indian River County; and <br />WHEREAS, in accordance with Florida Statutes §336.10, notice <br />of a public hearing to consider said petition has been duly <br />published; and <br />WHEREAS, after Consideration of the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said right- <br />of-way is not a state of federal highway, nor located within any <br />municipality, nor is said right-of-way necessary for continuity of <br />the County's street and thoroughfare network, nor access to any <br />given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the <br />public in and to at certain right-of-way being known more <br />particularly described as: <br />All that portion of road right-of-way known as Azalea <br />Lane lying east of the east right-of-way of Seagrape <br />Drive and the west boundary of Summerplace Unit 3, as <br />shown on a plat entitled "Oceanaire Heights Unit No. 1," <br />recorded in Plat Book 3, Page 84 of the Public Records of <br />Indian River County, Florida, <br />is hereby forever closed, abandoned, vacated, surrendered, dis- <br />continued, remised and released with the exception that drainage <br />and utility easements on and over a 10 foot strip along the east <br />line of Oceanaire Heights Unit 1 running the full width (70') of <br />Azalea Lane, and over the west 10 feet of the aforementioned <br />parcel lying perpendicular to the east right-of-way line of Sea <br />Grape Drive running the full width (701) of Azalea Lane, for a <br />public utility and drainage easement; also EXCEPT a 10 foot <br />easement lying 5 feet on either side of the existing centerline of <br />Azalea Lane, running from the east right-of-way line of Seagrape <br />Drive to the west line of the aforementioned easement of the <br />parcel described above is hereby reserved in perpetuity unto the <br />County and the public and shall not be deemed to have been closed <br />or abandoned in any by this resolution. <br />26 <br />
