solution to this problem that everyone could live with. <br />Referring to a map of the area, he pointed out that this property <br />is surrounded on 3 sides by industrial zoning and uses and on <br />2-1/2 sides by the City of Sebastian. He stressed that what we <br />are talking about today is not proposed uses, but uses that are <br />in place. Attorney O'Haire presented a folder of 9 colored <br />photographs showing the various industrial uses. (Photographs <br />are on file in the Office of the Clerk to the Board.) He <br />stressed that these are family -operated businesses, which are <br />grandfathered in, and what is being proposed might deal death <br />sentences to them so that their children could not run them in <br />the future. He emphasized that they are asking for the expansion <br />of uses not because of what is going to be there, but because of <br />what is there today. <br />Attorney O'Haire called the Board's attention to 3 limitations <br />on the home occupation use that he has drafted into the proposed <br />ordinance for this ROSE -4 area which he believed would protect <br />everyone in the future: <br />1) As a prerequisite to home occupational use in the ROSE -4, you <br />must go through the site plan process with all of its safeguards <br />to protect the neighborhood and the community; <br />2) The home occupations can be used only by members of the <br />family living on the property; and, <br />3) The property has to qualify and continue to qualify for <br />Homestead Exemption in the Property Appraiser's Office. If the <br />property does not qualify for Homestead Exemption, the right to a <br />permitted use of a home occupation disappears. <br />Chairman Scurlock asked if all the existing home occupations <br />are known and listed, and Attorney O'Haire stated that he knows <br />in his own mind what is there, and has tried to address those <br />uses in the drafted ordinance. <br />Chairman Scurlock felt there is no question that this is a <br />unique area and that is why the Commission has been so torn on <br />trying to address the issue. <br />45 <br />EB 24 1987 Boos 6 7 P, ,F 4 12,0 0 <br />
