No equipment or - <br />process shall be used in such home occupation which <br />creates noise, vibration, glare, fumes, odors, or <br />electrical interference detectable to the normal senses <br />off the premises; <br />2) Contractor's office and storage; does not comply with <br />section 25 (D) (6) d. Outdoor display or storage; <br />3) Lawn mower and small engine sales, service and repair; <br />does not comply with section 25 (D) (6) b. Merchandise. <br />No stock in trade shall be displayed or sold on the <br />premises. <br />The staff feels that the proposed home occupation uses are <br />inconsistent with the current ordinance. In addition, staff does - <br />not feel that the proposed uses can meet criterion (B) (4) (e) <br />(4) of the proposed_ ordinance which states that: "(4) traffic is <br />not generated in excess of that customary for residential uses." <br />The proposed uses would increase the amount of traffic in the <br />area., resulting in an increase in truck and heavy equipment <br />traffic, and would increase noise and other adverse <br />characteristics. This increased traffic would -not only have an <br />adverse impact on this area, but would impact the residential <br />area between the ROSE -4 area and Roseland Road to the north. <br />Legally established commercial uses in this area are <br />grandfathered in. This amendment would allow many more <br />commercial uses to be established in this area. <br />RECOMMENDATION <br />Based on the above analysiq, the .staff and the Planning and <br />Zoning Commission feel that the proposed home occupations are <br />inconsistent with the current home occupation regulations of the <br />County's Zoning Ordinance and recommend that this ordinance not <br />be approved. <br />Richard Shearer, Chief of Long -Range Planning, presented <br />staff's recommendation for denial of the request for expansion of <br />uses. <br />Commissioner Bird asked why this is County -initiated, and <br />Mr. Shearer explained that the Board directed staff to look at <br />this and come back with an ordinance and a recommendation for the <br />Planning & Zoning Commission. He noted that the Board did not <br />indicate at that time that they would necessarily approve the <br />expansion of uses just that they wanted to be able to take a <br />look at it. This came up when the ROSE -4 zoning district was <br />created in November. <br />Chairman Scurlock opened the Public Hearing and asked if <br />anyone wished to be heard in this matter.. <br />Attorney Michael O'Haire, representing.a number of property <br />owners in the just established ROSE -4 District, believed he has , -a. <br />44 <br />
